Gifty ("we," "our," "us") is a platform that helps people send gifts easily, without needing to ask for the recipient's address upfront.
We act solely as a purchasing facilitator — when you place an order, we buy the item from the original merchant on your behalf.
We are not affiliated with or endorsed by any brands whose products we list. Trademarks, logos, and product images belong to their respective owners.
2. Eligibility
You must be 18 years or older to use Gifty.
By using our service, you represent that you are legally allowed to enter into this agreement.
3. How Gifty Works
You choose a gift on Gifty and pay for it through our platform.
We then purchase that product from the original merchant and arrange delivery to the recipient you designate.
Product quality, warranties, returns, or defects are the sole responsibility of the original merchant.
4. Accounts, Security & Verification
You may create an account or use Gifty as a guest.
You're responsible for keeping your login details secure.
Phone Number Verification:
If you sign up or log in using your phone number, we'll send you a one-time verification code via text message (SMS) to confirm your identity.
You can choose to opt in to receive transactional updates via SMS in your profile settings. You can opt out at any time.
Message frequency varies based on activity (e.g., login attempts or order updates).
Message and data rates may apply.
We use trusted third-party service providers (such as Twilio) to send these messages securely.
We are not responsible for unauthorized account use if you fail to secure your credentials or devices.
5. Orders & Payments
Payments are processed securely through Stripe. We do not store credit card details.
When you place an order, we authorize a maximum hold on your payment method (covering estimated product price + taxes/shipping).
The final charge may be adjusted once the recipient provides their shipping address (e.g., if sales tax or shipping costs vary). Any unused portion of the hold will be refunded.
All sales are final. Orders may be canceled only before we begin processing the order with the merchant. Once processing begins, no refunds are available.
6. User Conduct
You agree not to:
- Use Gifty for any unlawful purpose.
- Engage in harassment, fraud, reselling, spam, or abuse of the platform.
- Attempt to bypass our systems or interfere with our operations.
7. Intellectual Property
Our website, design, and technology belong to Gifty.
Product images, names, and trademarks belong to the merchants and are used only to describe products available for gifting.
You may not use our brand, trademarks, or materials without our permission.
8. Text Messaging Terms (SMS)
We use SMS to verify your account at login/signup. You can choose to opt in to receive transactional updates via SMS in your profile settings. You can opt out at any time.
We do not send promotional or marketing texts without separate consent.
Opt-Out: You can opt out of receiving non-essential text messages at any time by going to your profile settings.
Message Rates: Standard message and data rates may apply.
Third-Party Providers: SMS services are provided through vendors such as Twilio. These vendors process your phone number and message data solely to deliver text messages on our behalf and are bound by strict confidentiality and security obligations.
Gifty is not liable for any delays, failed deliveries, or errors caused by your mobile carrier or third-party messaging platforms.
9. Disclaimers & Limitation of Liability
Gifty provides its services "as is" and "as available."
We do not guarantee that products will arrive on time or meet your expectations — that responsibility lies with the merchant.
To the fullest extent allowed by law:
We disclaim all warranties (express or implied).
Our total liability for any claim is limited to the amount you paid us for the relevant order.
We are not responsible for lost profits, indirect damages, or issues caused by third-party merchants, carriers, or communication services (including SMS providers).
10. Dispute Resolution
Binding Arbitration: Any disputes will be resolved through binding arbitration, not in court.
Class Action Waiver: You agree not to participate in class or representative actions against us.
Governing Law: These Terms are governed by California law. Arbitration will take place in California.
11. Termination
We may suspend or terminate accounts that violate these Terms.
You may stop using Gifty at any time.
12. Changes to Terms
We may update these Terms from time to time.
